I think of of percentile questions (when it is not a normal distribution) as just 100 people people. When they say 50th percentile, it translates to the 51st person has a value of 48.5. So others have to have a value lesser than or equal to 48.5 as the data is in ascending order. As a result, the 40th percentile can = 48.5 or anything below it. D.
