Issue Topic: Laws should be flexible enough to take account of various circumstances, times, and places.
Write a response in which you discuss the extent to which you agree or disagree with the statement and explain your reasoning for the position you take. In developing and supporting your position, you should consider ways in which the statement might or might not hold true and explain how these considerations shape your position.
In order to commensurate with “Let Hundred Guilty Be Acquitted but One Innocent Should Not Be Convicted.”, flexibility of Laws is an important aspect, which can be hinged on factoring in various circumstances, times and places. Not allowing a variety of circumstances and instances would lead to one-sided verdicts towards either the Criminal or the Victim. Both parties should be necessitated to present their evidences, before the final verdict. On several instances jaundiced judgements had resulted to defamation of individuals and also destruction of their professional careers.
For instance, in 2014, a Punjabi man (let’s call him Mr X), based out of New Delhi, India, was accused of sexual harassment by one of his female colleagues. The Hight Court of Delhi didn’t consider any evidences presented by the lawyers of Mr X, and convicted him of “Rape” charges which presented him with a 30year long sentence. After fighting for 5 long years, in 2019, he was finally vindicated and freed. But by that time, his jail term earned him a nickname of Rapist, and left a scar in his professional career as well. Had the Court listened to his side of the story, the scenario would have been different.
On the contrary, a very recent event in Bangalore, India, has caught netizen’s attention, where a lady accused a Food-Delivery guy of physical and sexual assaults. The guy was fired from his job by his organization. Fortuitously based upon evidences from CCTV cameras Bangalore High Court did not find the guy culpable.
In another instance, which includes my father, he was accused of being involved in an accident. He was passing by the accident spot and stopped be to call the ambulance for the victims. He was summoned by the Court several times before he was exculpated.
According to a report from the Times of India, feminism is being employed against men and suicides among men is burgeoning due to same. Similarly, misuse of the judicial powers by the authorities has always been a bigwig. Crimes against minorities are always neglected by police officials and Courts as well. In a recent disgraceful incident in Uttar Pradesh, India, a girl from a minority community was raped and burnt alive by members of the so-called higher caste. A month later, Lucknow High Court exculpated them.
To protect the “equal for all” concept of Law, it is thus the required to eradicate partially and biasness towards the privileged. Flexibility to consider various circumstances, times and places, is necessary in order to look at the event with different perspectives and examine them before reaching a conclusion.
