You are exactly correct. If the question does not mention "normal distribution" then it may or may not be normally distributed. And we cannot make that assumption!

As Chetan2u has indicated, since this question does not give us any indication of start of the data or how the percentages correspond to the numbers you cannot know where the 40th percentile is located. Hence D.
